By registering to use Cleveland Clinic MyChart, You accept and agree to be bound by these Cleveland Clinic MyChart: Terms and Conditions of Use. On Your acceptance of these Terms and Conditions of Use, an agreement will be formed between You and Cleveland Clinic (“Agreement”).

For the purposes of this Agreement:

Cleveland Clinic” means Cleveland Clinic London Ltd, a company registered in England and Wales with company number 09915684 and whose registered office address is at Suite 1, 3rd Floor 11-12 St. James's Square, London, United Kingdom, SW1Y 4LB.

You” means the Patient or Caregiver, as applicable. The “Patient” is the patient whose medical record is maintained in Cleveland Clinic MyChart. A “Caregiver” is the Patient’s proxy representative authorized by the Patient or applicable law (eg a parent or guardian), who may access portions of the Patient’s medical record through the MyChart Caregiver service as well as use any additional functions available to Caregivers.

FOR ALL MEDICAL EMERGENCIES, IMMEDIATELY DIAL: (I) IF IN THE UK, 999 OR 111; OR (II) IF IN THE EU, 112. DO NOT USE THIS CONVENIENCE TOOL TO COMMUNICATE MEDICAL EMERGENCIES. Never send any messages requiring urgent attention using Cleveland Clinic MyChart.

Summary of Cleveland Clinic MyChart

Cleveland Clinic MyChart provides You (the Patient or Caregiver) with online access to portions of the Patient's Cleveland Clinic electronic medical record. By using it, You understand that:

  1. Cleveland Clinic MyChart is designed as a secure Internet-based environment through which an Individual may receive certain confidential medical information released at the discretion of your physician. Individual is responsible for remembering the Cleveland Clinic MyChart ID and password and for keeping this information confidential. Individual is responsible for safeguarding the Cleveland Clinic MyChart ID, password, and security question and answer. Individual is responsible for keeping this information in a safe place for future reference. It is Individual's responsibility to prevent disclosure of Individual's ID and password and to change Individual's password and security question and answer if Individual feels that Individual's security has been compromised. The Cleveland Clinic shall not be liable for any damages that result from Individual's failure to keep such password secure.
  2. the Patient’s physician will be notified when You request a Cleveland Clinic MyChart account. You will gain access to the Patient’s health information if released by your physician into the Patient’s personal Cleveland Clinic MyChart account. Physicians may decide not to make certain health information viewable on Cleveland Clinic MyChart.
  3. You are solely responsible for any sharing of Cleveland Clinic MyChart content that You communicate to others.
  4. You understand that You may receive messages, test results, and other communications delivered via Cleveland Clinic MyChart.
  5. You may not be provided paper versions of the information contained in Cleveland Clinic MyChart; however, You may request a copy of the Patient’s medical record from Cleveland Clinic according to the request procedures described here.
  6. You are solely responsible for remembering the Cleveland Clinic MyChart ID and password and for keeping this information confidential.
  7. You must contact Cleveland Clinic immediately if you believe someone has unauthorized access to Your Cleveland Clinic MyChart credentials or patient records.
  8. No confidential information will be sent from Cleveland Clinic MyChart to Your email, but You will receive email notification whenever a new result, message, or other communication has been released to Your Cleveland Clinic MyChart account or in situations where Cleveland Clinic provides a general notice to MyChart users through the email account provided at the time of MyChart activation. You may receive from time to time important email notices and messages from Cleveland Clinic. You must verify and update Your email address via the My Preferences link to ensure that You receive notification of newly released information and general notices in a timely manner.
  9. You can discontinue use of Cleveland Clinic MyChart at any time by contacting MyChart Help Desk at (+44) 0203 423 7008 or by e-mail [email protected]
  10. You may only use Cleveland Clinic MyChart for personal use (ie for Your use as a Patient or Caregiver, as applicable).
  11. If the Patient’s physician is out of the office or unavailable to respond, messages sent via Cleveland Clinic MyChart may be routed to other Cleveland Clinic personnel in order to facilitate a timely response to Your request.
  12. All communications between You and the Cleveland Clinic health care team using Cleveland Clinic MyChart are sent by encrypted connection directly into the Cleveland Clinic electronic medical record.
  13. Cleveland Clinic retains sole authority to grant, decline, suspend, or revoke any access to Cleveland Clinic MyChart for any reason, including based on inappropriate use of such service, applicable legal requirements or whether providing, or continuing to provide, access poses a risk to the patient.
  14. You acknowledge that Cleveland Clinic’s Privacy Policy is available at Privacy Policy.

The only commitments Cleveland Clinic makes about Cleveland Clinic MyChart are described in this Summary of Cleveland Clinic MyChart. Cleveland Clinic does not make any other commitments about Cleveland Clinic MyChart. Cleveland Clinic can stop providing Cleveland Clinic MyChart at any time. Eligibility

Cleveland Clinic provides access to Cleveland Clinic MyChart in the following circumstances:

  1. If You are a Patient under the age of 13, Your parents or guardian will have sole access to Your health records with Cleveland Clinic MyChart.
  2. If You are a Patient aged 13 years or older and younger than 16, You may request access to Cleveland Clinic MyChart and your physician will determine whether, under applicable standards, such access is appropriate. Cleveland Clinic does not automatically remove Caregivers who previously had access to Cleveland Clinic MyChart, such as parents or a guardian, but You have discretion to remove any Caregiver.
  3. If You are a Patient aged 16 years or older, You will receive access to Cleveland Clinic MyChart. Cleveland Clinic does not automatically remove Caregivers who previously had access to Cleveland Clinic MyChart, such as parents or a guardian, but You have discretion to remove any Caregiver.
  4. If You are a Caregiver with valid legal documentation providing You with rights to access a Patient’s health records (such as a healthcare power of attorney) or a court determines that the Patient does not have capacity and grants You the rights to make healthcare decisions about the Patient without capacity, Cleveland Clinic will provide You with access to such Patient’s Cleveland Clinic MyChart.

Caregivers

If You are a Caregiver seeking access to a Patient’s health records in Cleveland Clinic MyChart, You warrant that You have the authority to access such records. If Your status to the Patient changes, You must notify Cleveland Clinic immediately for Cleveland Clinic to terminate Your access to the Patient’s health records.

Patient/Caregiver Access to Data

You may request access to Patient data that is not contained in Cleveland Clinic MyChart under the terms of the [Patient] Privacy Notice.

Patients Permitting Caregiver Access

If You are a Patient and You appoint a Caregiver user through Cleveland Clinic MyChart, You understand that:

  1. the Caregiver will be able to access Your Cleveland Clinic MyChart account and all of the information in the account, as well as any additional functions available to Caregivers, which may include the ability to download and transmit to third parties Your information contained in Cleveland Clinic MyChart.
  2. the Caregiver may take action on behalf of You via Cleveland Clinic MyChart.
  3. if You no longer wish for Your Caregiver to have access to Your Cleveland Clinic MyChart account, except as required under any applicable legal requirement, You can revoke a Caregiver’s access through the Cleveland Clinic MyChart site or by written notice to Cleveland Clinic in accordance with the [Patient] Privacy Notice.
  4. if You have designated a Caregiver, Cleveland Clinic will send You an annual notice as a reminder to review Your Caregiver designation.

Settling Disputes, Governing Law and Courts

English law will govern all disputes related to Cleveland Clinic MyChart, regardless of any conflict of laws rules. The courts of England and Wales are the exclusive location for resolving any such disputes.

Cleveland Clinic may update or modify this Agreement in the future.
